Firebrand lawyer Miguna Miguna has reacted after the High Court heavily fined retired President Daniel Arap Moi over land fraud.
Justice Antony Ombwayo on Thursday found Moi guilty of grabbing a 53-acre piece of land and ordered him pay Sh1 billion.
The money will go to the complainants, Susan Cheburet Chelugui and her son David Chelugui, who own the land situated in Eldoret town.
Miguna said the court should have not only ordered Moi to compensate the family but should have also imprisoned the politician.
He criticised the Director of Public Prosecutions (DPP) Noordin Haji and Director of Criminal Investigations (DCI) George Kinoti for allegedly preferring a lesser charge against the former president.
"Land grabbing is theft. Daniel Moi stole land belonging to those poor peasants. The DCI and DPP should have charged him with theft. Moi should not just return the land he stole and fully restitute for the theft; he should serve time in jail," he tweeted.
The outspoken lawyer further accused President Uhuru Kenyatta and former Prime Minister Raila Odinga of hypocrisy over how they have treated the Nairobi's Weston Hotel land case.
He claimed the two have been condemning Deputy President William Ruto, who owns the prestigious hotel, over land grabbing while keeping quiet on Moi despite facing similar allegations.
"Uhuru Kenyatta, Raila Odinga and their sycophants have been shouting about the Kenya Aviation Authority land William Ruto grabbed and built Weston Hotel on yet they are drooling all over Daniel Arap Moi whom the High Court has "fined" for stealing land. Theft is theft. Hypocrites!" said Miguna.
