Gospel artist DK Kwenye Beat risks 15 years in jail or even life imprisonment should the issue he is facing take a fresh twist to the courtrooms.

DK Kwenye Beat is alleged to have engaged a university student from Nakuru in a threesome together with fellow gospel artist Hope Kid.

The lady who is said to be 20, accused DK Kwenye Beat of intentionally infecting her with an STI that has since costed the lady more than Sh20,000 on futile treatment attempts.

DK Kwenye Beat has then offered an apology for what he said he engaged in 'sin' in last year before seeing the light of real salvation. He, however, does not directly link his apology to the girl in question.

 

According to Kenyan laws, DK risks at least 15 years in jail should he be found guilty if at all the varsity student will want him charged.

The girl claimed she was forced into a threesome, which in simpler term, can be said to be group rape. And the law of Kenya under Sexual Offences says such is treated as gang rape. 

"Any person who commits the offence of rape or defilement under this Act in association with another or others, or any person who, with common intention, is in the company of another or others who commit the offence of rape or defilement is guilty of an offence termed gang rape and is liable upon conviction to imprisonment for a term of not less than 15 years but which may be enhanced to imprisonment for life," the Act stipulates.

Another Sexual Offence that he is likely to face is covered under Section 26(1) (c) of Kenya’s Sexual Offences Act, which criminalizes the wilful transmission of STIs and HIV/Aids.

"Where a person is convicted of any offence under this Act and it is proved that at the time of the commission of the offence, the convicted person was infected with HIV or any other life threatening sexually transmitted disease whether or not he or she was aware of his or her infection, notwithstanding any other sentence in this Act, he or she shall be liable upon conviction to imprisonment for a term of not less than fifteen years but which may be enhanced to imprisonment for life," the law states.

In the meantime, the lady in question has not hinted her next step over this matter.
