Migori Governor Okoth Obado will have to reapply bail afresh after High Court Judge Jessie Lessit dismissed an application made by his defense team.
Mr. Obado, who was arrested last Friday, will be remanded at Industrial Area prison for ten more days after which he will appear along his co-accused.
In her ruling, Ms. Jessit said the prosecution's decision to consolidate the case has to some extent compelled her to arrive at the decision.
"On the security concerns, I do agree the danger of releasing him but no witness has recorded a statement about threats.
"About his powers, the court can still limit it by imposing certain measures. However, now that the matter has been consolidated, they all have to appear together on October 8th," she ruled.
The ODM governor was arraigned in court on Monday and charged for the murder of his ex-girlfriend Sharon Otieno earlier this month.
Following the court ruling, he will appear along with his aides Caspal Obiero and Michael Oyamo, both who have been denied bail as well.
At Milimani law courts, the governor appeared relaxed and was chatting freely with his constituents and at times he was seen laughing.
Prosecutors accused him of coordinating and financing Sharon's murder, adding that his phone was located at the crime scene.
While Obado agrees impregnating Ms. Otieno, he however insisted that he had nothing to do with the mysterious murder.
