Justice Monica Mbaru stayed the resolution to disband the board pending inter party hearing on December 5.

In her ruling, she directed all board members to resume office until the matter is heard and determined.

Four board members moved to court to challenge their removal from office.

Through their lawyers, the lot argued that due process was not followed in their removal.

They claimed that their constitutional rights were violated since they were not accorded fair hearing.

The allegations raised against the board members according to the lawyer were serious and it is a requirement they be heard before any action is taken against them.

A motion to disband the board was passed on Tuesday, and members agreed to elect a new board.

MCAs said the board had failed in the management of the assembly affairs, citing salary delays, lack of airtime and cash for fuel.

Over 40 MCAs voted to disband the board terming it as immoral and incompetent.

They said the board took advantage of MCAs who requested for allowances to ask for sexual favors in return.

Among the allowances cited were those for per diems, foreign travels, fueling of vehicles and airtime.

The MCAs said the disbandment had come at the right time to save female legislators from the board members.
