Nakuru County Assembly Deputy Speaker Samuel Tonui is with no doubt a happy man after the high court awarded him Sh200, 000 for unlawful impeachment.

While delivering her ruling, Justice Janet Mulwa said the complainant’s rights had been violated in the process that saw him impeached.

Tonui had filed a case against then Speaker Susan Kihika, assembly clerk Joseph Malinda and MCA Moses Kipkoros Tuei following his dismissal. 

 “Petitioner’s right to fair administrative action has been breached by the Speaker (Susan Kihika),” she ruled.

 Tonui had moved to court in 2015 after he was sent packing in an impeachment motion.

Through his lawyer Kipkoech Ngetich, Tonui pushed for his reinstatement following what he termed as malicious sacking.

 He was later elected into office in the same capacity

The politician, who was first elected in 2013, claimed that the MCAs had been manipulated by the trio to orchestrate his removal from office without any form of wrongdoing.
