The Orange Democratic Movement (ODM) will not hold fresh nominations for the vacant Ugenya parliamentary seat, it has confirmed.

The seat fell vacant after the Supreme Court's nullification of area lawmaker Chris Karan in December, bringing to an end his tenure that began after the August 8, 2017, general polls.

According to party Secretary General Edwin Sifuna, ODM will use a legal argument brought to power by the Supreme Court during the August 8 presidential election nullification.

'We will follow the precedent set by the Supreme Court, which said that in a by-election there is no need for holding fresh party nominations," he was quoted by the Standard.

The seat fell vacant following a successful appeal by former legislator David Ochieng of the Movement for Democracy and Growth (MDG) party.

The petitioner, formerly a member of the ODM party cited a number of electoral malpractices, among them malicious propaganda during the campaigns by some ODM members.

Both leaders have since embarked on campaigns, in a race that only the two of them are involved in so far, NP other candidate declaring an interest in the seat. 

ODM party leader Raila Odinga has since deployed a strong group of Siaya county leaders under the leadership of Governor Cornel Rasanga to aid in delivering the seat back to the party.
