The High Court on Friday directed a school to readmit a student who had been sent home over her religious beliefs.
The management of Olympic High School has been directed to reinstate the student after she confessed her Rastafarian links.
The student, whose identity has not been disclosed, was sent home in January after she refused to shave her dreadlocks.
According to the management the student has failed to adhere to the rules of the place and hence was unfit to continue with her education. The student, however, said that the administration was interfering with her freedom of worship.
“The rule that she cuts her hair is intrusive to her religion and not justifiable in a democratic country,” Justice Chacha Mwita said, as quoted by Citizen Digital.
The father of the student opted to seek legal redress on January 14, 2019 after school’s Board of Governors kicked out the student. The family of the student, who was in form at the time of the incident, said that they are Rastafarians and so is the child.
He told the court that the Bible forbids them from shaving their hair. He lamented that schools should not sideline some students because of their religious beliefs.
“School rules stand in her way to religion and education…the school rules have been applied in a manner to deny her to receiver her education violates the article to the right to her religion,” he said.
