Senate Majority Leader Kipchumba Murkomen has come out to respond to remarks made by former Jubilee Party Vice Chairman David Murathe against Deputy President William Ruto.

Over the weekend, Murathe threatened to move to the Supreme Court to block Ruto from vying for the presidency in the next general election.

The former Gatanga MP argues the DP is disqualified from the race to State House having served alongside President Uhuru Kenyatta for two consecutive terms.

"In effect, if he (Ruto) automatically becomes president without going for the mandate from the mwananchi (citizen) then that is why 148 says you cannot run again. Na nitaenda mpaka Supreme Court. Sisi hatucheki na watu ," the vocal politician said during a funeral service in Nyanza on Saturday.

But Murkomen said Murathe would be in for a rude shock if he moves to the Supreme Court, saying the top court will dismiss his case since it would be premised on "things that do not exist in the law".

"People have been taken to court for things that do not exist in the law, so it will not be first time," he said speaking during a Sunday mass at Revival-Sanctuary of Glory Church in Riruta Satellite, Dagoretti South, Nairobi.

In a post on social media on Saturday, Murkomen said 'desperate' Murathe was contemplating to move to court after realising there were no other ways of blocking Ruto from taking over power from Uhuru.

"Since voters are impossible to convince and considering we can’t change the Constitution, we should go to Supreme Court to stop him by all means. Ama namna gani my fren?" the Elgeyo-Marakwet Senator said in a tweet.
