City lawyer Assa Nyakundi's murder case has been postponed. The case was adjourned on Friday after he requested time to challenge the legality of the whole matter.

The Director of Public Prosecution had objected the move to charge the lawyer of manslaughter following the mysterious shooting of his son Joseph Bogonko Nyakundi on March 17. 

The office of the DPP had applied for the review of the case on the grounds that the court was too lenient on the suspect.

While delivering the ruling,  justice James Wakiaga postponed the case to allow the defense team prepare for the case.  He also extended the push for Nyakundi to be released on a Sh300,000 bond to July 9. 

Justice Jessie Lesiit is now expected to take charge of the case. He is also expected to issue further direction in connection with the case. 

Lawyers Dunstan Omari, John Khaminwa and Harun Ndubi are expected to argue in the case as the family await for justice from the courts. Ndubi and Khaminwa are expected to file applications under the Section 276 (1) (2) of the Penal Code to determine the murder case.

On his part, Dr Khaminwa said that the manslaughter case is under the Kiambu court. He argued that DPP Haji had attempted to transfer the case from the Kiambu court but his efforts never bore fruits at the end of the day. 

“Before determination of the manslaughter case, the DPP filed a murder case before this court. The DPP has now dashed to this court with a murder charge arising from the same incident as the manslaughter one,” he said, as quoted by Daily Nation.
