In a Thursday ruling, justice Roselyn Aburili said that the court cannot afford to gamble with the lives of its people.In her ruling.

However, she pointed out that former Health CS Cleopa Mailu did not follow the Constitution when he issued the ban.

Mailu was also faulted for failing to indicate to the court of intentions to table the legal notice before Parliament for debate.

Lack of public involvement was also cited as a shortcoming from the side of Mailu.

“Fair administrative action is a right guaranteed in the constitution,” ruled Justice Aburili.

The court, however, ruled that there was no evidence before to show that Shisha business is unlicensed and directed that the Ministry complies with the rules within nine months.
