High Court Judge Mugure Thande first dismissed the case filed by a petitioner Mwamlole Tchapu Mbwana in November 2017, saying he did not follow election petition rules when filling it.

However, the case was appealed by three voters who had picked Mwamlole to present the case, after taking issue with the High Court's decision.

Suleiman Mwamlole Warrakah, Matsudzo Hamisi Mwamrez and Mwarapayo Wa-Mwachai appealed the case, arguing that Mvurya who left ODM for Jubilee party, was not validly elected.

During the August 2017 elections, Mvurya garnered 119,680 votes beating his closest rival Chirau Ali Makwere of Wiper Democratic Movement who got 29,741.
