The Director of Criminal Investigations (DCI) wants Deputy Chief Justice Philomena Mwilu’s lawyer charged for lying to the court.
According to the DCI, the lawyer, Stanley Muluvi lied to the court that detectives raided his office before arresting him in a bid to obtain evidence against his client.
The DCI said that the lawyer used dubious means to stop the trial of the DCJ following her links to Sh60 million fraud. In a sworn affidavit filed by Inspector Arthur Onyango, the DCI said that Muluvi told the court lies while attempting to set his client free.
He said that Mwilu and the lawyer colluded to defraud Kenya Revenue Authority through a scheme to avoid tax payment and Imperial bank.
The DCI said that Muluvi had gone against the code of conduct in the field of law following the incident.
He further said claims that the office of the DCI had obtained evidence from the client through unlawful channels was just an afterthought after the lawyer realised things were not working in his favour.
“He has failed to demonstrate how we acted in bad faith by preferring the charges against him. His contention that we obtained evidence illegally is an afterthought. He only wants to hang on the decision to acquit Mwilu when he has no basis to stop his trial,” swore Onyango, as quoted by Standard.
The charges levelled against Mwilu were dropped.
