At Egerton University on Saturday, Maraga is said to have said that the KNEC chairman is qualified and does not need to be subjected to any form of vetting by authorities.

But in a rejoinder, Maraga insists that vetting is mandatory and that the National Assembly approves such appointments by the Head of State contrary to what the media said.

"The story appearing in one of the local paper which says that Prof Magoha should not be vetted by National Assembly is untrue," says the statement, which was released after 24 hours.

It adds: "Article 132(2) a of the constitution is very clear that the National Assembly shall approve Presidential nomination and appointments of Cabinet Secretaries. That is the law and it remains so."

Magoha is expected to be grilled by National Assembly Education Committee before recommendations are tabled to parliament for voting once President Uhuru Kenyatta forwards his name to the house, a process which could take a couple of days.

Should he be approved, he's taking over from Amina Mohammed, who moves to the ministry of youths and Sports which was vacated by Rashid Echesa. Mr Echesa was sacked by the president.

He will become the forth minister to occupy Jogoo House under Uhuru's administration after Jacob Kaimenyi, Dr Fred Matiang'i and Amina Mohammed. He has however worked with the three ministers before.
