Irene Mayaka, the ring leader of Daughters of Raila campaign group, will still have to wait longer to be reinstated as nominated MCA despite Appeals Court ruling that went in her favour.
Her competitor, Damaris Mouni, through one David Nyagarama, moved to court challenging nomination procedures by ODM party, thus managing to get orders retraining Speaker Moffat Teya from kicking her out.
"The Appeals Court ruled that it had no jurisdiction to listen and determine an appeal that has been handled in a lower court. And as such, the speaker should have me in the assembly as the other lady fights from outside.
"This is total sabotage but I will still seek justice. The court found out that she fraudulently rigged me. I am confident that I'll be at assembly soonest," she said.
Mrs Mouni lost her cases both in the Magistrate and High Court but has been raising matters over her nominations from court thus dragging the issue at hand.
Orange Democratic Movement party disowned her nominations, asserting that Mayaka was the validly nominated candidate by the party to serve in Nyamira County Assembly, a move which Mouni disputes.
Party lawyer Tony Moturi said the party will formally write to Speaker Teya to effect the Appeals Court ruling, terming the latest petition as a non issue.
"Irene must first get to the assembly then the court sorts the latest petition. We can definitely not defy court orders. In fact, we are told the order that was raised is fake," he said.
