The Salaries and Remuneration Commission (SRC) has come out to oppose the move by Members of Parliament to increase their allowances terming it is against the law.
In a presser on Tuesday in Nairobi broadcasted by various media outlets, SRC Chair Mengich Lyn noted that Parliament has no power to determine their salaries.
"Article 260 of the Constitution of Kenya categorises Members of Parliament as State Officers and as such, determination of their remuneration and benefits is the exclusive responsibility of the SRC," noted Mengich.
"Any Payment of any remuneration and benefits, which have not been set or advised by SRC is in violation of the Constitution," she added.
The SRC boss further revealed that they are reviewing the MPs' move and will soon take appropriate actions even if it is a legal one.
The salary increase will see each MP earn Sh1.33 million per month, making them the highest paid public officers in the country.
With the National Assembly having 350 legislators, each of them will pocket a whopping Sh16 million annually from the current pay, both basic salary and personal allowances included, standing at Sh15.4 million a year.
The move by MPs has received criticism from a section of Kenyans and leaders with COTU secretary general Francis Atwoli supporting them citing the increased handout demands from the public.
