Earlier before her request, the court had postponed Dominic Musyoka’s trial due prosecution's failure to table doctor's report in a move to build the case that involves a standard five pupil.

The 10-year old’s mother was disappointed by the failure of the doctor to present the examination report hence the protest.

She faulted the court’s commitment to ensuring that her daughter gets justice.

"This court should grant me permission to pursue the issue using the Kikamba way," she said.

She highlighted her plea in a philosophical manner.

The court's Senior Resident Magistrate Gerald Mutiso told her to clarify the request.

The woman recapped on her statement indicating her readiness in seeking for justice off the court, the Kikamba way.

She pleaded with the court to grant her permission to do so, bewitch the accused.

However, the magistrate instructed that she gets further directives from the court's prosecutor Tito Wanga.

Mutiso said the doctor's missing report prompted the adjournment of the case since it was important in building the case.

Issuing the last adjournment, Mutiso gave his final statement moving the case to February 4, 2017.

The minor's sexual assault allegedly occurred in 2016 during the Valentine's Day at Machinery market in Kibwezi East.

The suspect who is a Secondary School teacher is alleged to have bought the girl a bottle of soda and asked her not to reveal the ordeal to anybody.

He was released on a Sh200,000 bond.
