Siaya MCAs on Thursday fired Assembly Clerk Felix Olwero despite there being a court order protecting the latter from ouster.
Olwero had obtained a court order making him immune from any disciplinary action in the gross misconduct allegations levelled against him by the assembly.
Olwero is accused of using his accounting officer's position to channel Sh2 million from the assembly car loan and mortgage account to his personal account.
However, this is in contravention to a June 13 ruling by Nairobi Employment and Labour Court Judge Onesmus Makau who directed that no disciplinary action be taken against him until his suit is heard and determined on July 7.
Olwero had moved to the court seeking to have the house barred from declaring the position empty or employing another person to hold the position, reports the Standard.
The judge further ruled that the case be heard at the Kisumu court, but the MCAs on Thursday directed that his dismissal letter be written, and the Sh800, 000 unpaid loan to be paid.
Appearing before a select committee on Wednesday, the county official who was suspended three months ago dismissed the allegations.
He requested the house for the audit committee reports, financial and bank statements to enable him to respond to the claims.
