The prosecution made major strides, Monday after managing to oppose a police bond pursued by Michael Oyamo, Governor Okoth Obado's personal assistant.
For six days now, Oyamo has been under police custody in connection to Sharon Otieno's mysterious murder.
Homa Bay resident Magistrate Lester Simiyu insisted that Oyamo was rightfully in court and that his rights had not been infringed.
"So according to the Constitution the suspect is properly before me....I am the deputy registrar. And I am also in order stepping in for the duty judge who is away on leave," she said.
She ruled that Oyamo would be arraigned in court on Tuesday to be charged even as leaders across the country continued to call for prosecution of Governor Obado.
And in her ruling, she defended the court insisting that the law allowed her to hear the matter.
"Oyamo will not only be accessed by his lawyers but also by Lillian Wema and any other close family member, spouse or child," she ruled.
The OCS was also asked not to transfer the suspect to another police station.
According to Journalist Barack Oduor, Mr. Oyamo played an integral role in the kidnapping of the Rongo University student and subsequent murder.
Sharon's mother, Melida Auma, said that her daughter was in a romantic relationship with the Governor and that she had been requested to abort his pregnancy.
Even though Obado has defended himself from the allegations, he has however dispatched his legal team led by Cliff Ombeta to monitor the clandestine case.
