Officers from the Directorate of Criminal Investigations (DCI) on Thursday last week camped at the Makueni County Assembly premises ready to arrest Mbula Mutula, a nominated ward representative.

However, their efforts proved futile after discovering that the Member of County Assembly (MCA) had tricked them by leaving the phone they were tracking inside the chambers.

The outspoken MCA was then whisked out by friends only to present herself to the National Cohesion and Integration Commission (NCIC) offices on Monday accompanied by her lawyer where she was questioned.

The MCA was later ferried back to Makueni and arraigned at Makueni law courts before Senior Principal Magistrate James Mwaniki.

During her arraignment in court, drama ensued as Wiper affiliated MCA's and angry youths shouted at the police. They tried to force their way into the court premises but their efforts were thwarted. 

The court heard that on November 19, 2017, the accused through her Facebook page wrote that "Mungiki in police uniform were slaughtering NASA supporters mercilessly and Uhuru was happy about it".

Particulars of the offence implicated that a certain tribe in the country was cursed and should be chased from certain Kenyan regions and their businesses boycotted.

According to the prosecution, the post had a possibility of stirring ethnic hatred against a certain tribe and Kenyans by extension.

The MCA denied the charges levelled against her terming them as falsehood. She was however asked to pay a bond of Sh800,000 and a surety of the same amount or pay a cash bail of Sh400,000.

The case is set for mention on April 15 with the hearing date set for May 28. 

Outside the court, Mbula told the press that her arrest is a result of a witch-hunt within Makueni saying that she didn't expect to be arrested three years after the alleged inciting Facebook post.
