The High Court in Nairobi has found a matatu driver guilty of killing his girlfriend after discovering that she was about to leave him for another man.

Justice Stellah Mutuku found Omar Waithaka guilty of murdering Yvonne Njoki Maina saying that the prosecution had proven its case.

The court heard that the accused person murdered his girlfriend by throwing her from the third floor of their residence in Nairobi’s Buruburu estate on New Year of 2012.

Judge Mutuku in her ruling said the accused picked the late Njoki from her parents’ home in Lang’ata to spend time together as they usher the New Year.

Waithaka who said they were going for a miraa chewing spree took Njoki to Nairobi West to have drinks before driving home in his matatu to Buruburu.

“It is in Buruburu where Omar heard Njoki talking to a Mr Wambugu who was enquiring where she had gone yet they were supposed to link up,” said Justice Mutuku as quoted by the Nation.

Wambugu who was still on the phone heard Njoki screaming and decided to call her parents as he feared for her safety.

The accused person rushed Njoki to Metropolitan Hospital where she was pronounced dead.It was however revealed in court that the accused was very violent and at one time he pushed Njoki out of a moving vehicle.

According to the judge, medial reports presented in court showed that injuries on Njoki’s body were inflicted and not consistent with a fall as claimed by the accused.

The accused person however in mitigation pleaded for mercy saying he was remorseful and regretted his actions adding the he is young and wants to make his contribution in the society.

Justice Mutuku will sentence the accused on June 10, 2019.
