Swazuri is battling a case where he and other suspects are charged with alleged irregular and fraudulent land compensation payments.

Milimani Anti-Corruption Chief Magistrate Lawrence Mugambi will make the bail ruling on Tuesday next week.

The Director of Public Prosecution (DPP) Noordin Haji has oppossed the release of Swazuri and other accused persons on bail.

The DPP argues that the accused are likely to interfere with witnesses and tamper with evidence if granted bail.

The prosecution also claims that Swazuri is likely to abscond trial if released on bail.

Swazuri and other accused persons pleaded not guilty to charges of alleged fraudulent land compensation for construction of Mombasa Southern Bypass and Kipevu New High Terminal link Road in October 2013.

The former NLC boss is alleged to have made irregular payments to Tornado Carriers Ltd for compulsory acquisition of land in Mombasa.

The accused also pleaded not guilty to charges of conspiracy to commit economic crime, abuse of office, financial misconduct, money laundering and unlawful acquisition of public property.

The DPP in a statement on Wednesday said he has enough evidence to prosecute the charges against Swazuri and other accused.

Swazuri and other accused will be detained at the Ethics and Anti-Corruption Commission (EACC) police station.
