Last month, Registrar Esther Nyaiyaki led both parties in pre-trial conference in which terms and conditions were agreed on the case.

And Chief Justice David Maraga will lead four other judges in hearing the case, the first ever to be filed by a gubernatorial loser at the Supreme Court.

Mr. Nyambati lost both in the High Court and Appeals Court before moving to the elections court for determination.

In the Appeals Court ruling at Kisumu, Nyambati accused the presiding judges of allegedly being compromised. He also blamed Interior Cabinet Secretary Fred Matiang'i of interfering with the case.

During last year's polls, IEBC declared Nyagarama, the ODM candidate winner of the election having garnered 65,000 votes. Nyambati was second with 59,000 votes.

In his court argument, Nyambati claims that there was massive irregularities and illegalities in over 24 polling stations of the 552 across the county.

At the Supreme Court, his team was allowed to give new evidence, which is normally discouraged by Appeals Court.
