Embattled Nairobi lawyer Assa Nyakundi is expected to be arraigned in court today to face a murder charge.
The prominent lawyer was arrested on Wednesday and detained in police custody and will be arraigned at the Milimani Law courts to plead to a charge of allegedly killing his 29-year-old son, Bongonko Nyakundi on March 17, 2019.
According to Capital FM News, the Director of Criminal Investigation (DCI) George Kinoti and Director of Public Prosecutions (DPP) Noordin Haji have okayed Nyakundi’s murder charge.
“He (Nyakundi) is in our custody and will be in court for a murder charge,” Kinoti told Capital FM News.
Nyakundi was initially charged with a manslaughter charge but the DCI said he did not approve the file, noting that there was a conspiracy between the detectives who were handled the case to defeat justice.
The detectives are currently on interdiction for subverting justice.
The lawyer's arrest on Wednesday came hours after Milimani Law Court Judge Ngenye Macharia directed that the application filed by DPP to have the manslaughter charge against him dropped so that he can face murder charge be placed before Justice Luka Kimaru.
The arrest also came after Kiambu High Court Judge Christine Meoli recused herself from hearing the case citing conflict of interest. She instead referred it to the Milimani Law Courts.
In her recusal, Judge Meoli noted that Nyakundi was once her classmate.
The lawyer told detectives that he was trying to hostler his firearm while in the car when he accidentally shot his son.
