Former Lagdera MP Farah Maalim has lauded the High Court ruling that saved Deputy Chief (DCJ) Justice Philomena Mwilu from facing criminal prosecution over alleged abuse of office and tax evasion charges.
On Friday, Mwilu survived criminal prosecution after a five Judge bench ruled that the Director of Criminal Investigation (DCI) George Kinoti obtained evidence against Mwilu illegally.
On Saturday, Maalim took to his official Twitter handle to laud the Judge’s ruling.
“High Court Judges did a Sterling job. The judgment in the DCJ matter had the Hallmark of a case law to be sighted in law schools for years to come,” he tweeted on Saturday.
In his tweet, the Wiper Party Deputy Leader added, “The Process of obtaining evidence is extremely important. Felicity to the letter and spirit of the law and attention to finer details”.
Justices Hellen Omondi, Mumbi Ngugi, Francis Tuyiot, William and Musyoka in their ruling faulted the DCI for allegedly using illegal means to access Mwiu’s bank account.
The ruling continues to elicit debate among legal scholars and even politicians in the country as the Director of Public Prosecutions (DPP) Noordin Haji vows to appeal in the Court of Appeal.
Haji has also vowed to push the case against the DCJ through the Judicial Service Commission (JSC).
Mwilu was briefly arrested last year over the collapse of the Imperial Bank, with DCI Kinoti accusing her of allegedly borrowing money and failing to repay.The bank was put under receivership. The DCJ was also accused of tax evasion.
She, however, filed a petition challenging the criminal charges that the DPP and DCI had preferred on her claiming that they were malicious and politically instigated.
