On Monday 10th September, the petition No. 28 of 2018 in which he has disputed Governor John Nyagarama's victory, will be mentioned before Deputy Registrar, Supreme Court.

So protracted has been the rivalry between the two, that Nyambati accused appeals judges in Kisumu of receiving bribe to quash his evidence.

"We had a water tight case and that is why we are moving to Supreme Court.

"Money exchanged hands and CS Matiang'i interfered with the case. We shall prove that in Supreme Court," his lawyer, Osoro Mogikoyo had said.

Also in his defense team is Uhuru's lawyer, Fred Ngatia, who is credited for the president's second Supreme Court victory last year.

During the 2017 polls, Nyambati emerged second with 59,000 votes while Nyagarama was declared winner with 65, 000 on ODM ticket.

Efforts by Matiang'i to have the two shake hands have hit a snag in previous attempts.
