A Mombasa-based lawyer, Robinson Malombo, has been forced to withdraw from a land case after the court directed that he clearly explains whether his client dead or alive.

Claims that his client, Joash Adamba is dead and a demand for an explanation from Environment and Land Court has forced him to file an application to withdraw from the case claiming he is not able to reach his client.

In the withdrawal application before the Environment and Land Court judge Anne Omollo, Malombo says that there is no communication hence he is not able to continue with the case.

“I have since been unable to get to my client to give further instructions on the matter since there is need for further affidavit, which is necessary to enable me file the same to prosecute and or take care of his interest,” Malombo said in the application as reported by Nation.

His client had moved to court to determine rightful owners of prime land located in Nyali whose value is more than Sh75 million.

Adamba has been sued over ownership of the said land in Nyali.

However, two people,  George Adamba Musiega and Judith Liveha have issued a notice that has a different law firm, Wandabwa Advocates, as their representatives in the case. They claim to be administrators of  Adamba’s estate.

“Take notice that Mr Musiega and Ms Liveha (the administrators of the estate of the estate of Joash Adamba (Deceased) the defendant herein have appointed the firm of Wandabwa Advocates to act on their behalf,” the notice reads.

There are several controversies surrounding the piece of land which is sitting idle.
