The two Mariakani police officers accused of shooting dead a 17-year-old boy at Kaloleni will remain in custody after the Malindi High Court denied them bond.
Simeon Oyoo Ayodo and Amos Kiptoo Kipsang who on Tuesday appeared at the Malindi Law Courts, were charged of killing Katana Kazungu at Tsangatsini in Kaloleni Sub-county within Kilifi County on June 26, 2018.
They will be held at Malindi police station until Thursday, February 14, 2019, when they will take plea.
Prosecution counsel, Babra Zombo successfully convinced the court to give the investigating officers more time to escort the two to the hospital for mental assessment and present a report to the court on Thursday.
“I pray the court to deny the two bond, and allow them to be held at Malindi police station because mental assessment is yet to be done,” said Babra.
Judge Weldon Korir denied the defendants’ lawyer Matete Katoto’s plea for the two to be released on bond for being co-operative with the court, on the basis that they are yet to take plea despite need for a mental report.
Judge Korir said, “Simeon Oyoo Ayodo and Amos Kiptoo Kipsang are hereby charged with murder but will be allowed to take the plea on Thursday when the mental assessment report is availed in court.”
Speaking outside the court buildings, Kaya Fungo ward representative Alphonse Mwaya said that despite waiting for long, the family is now starting to see the fruits of the case.
Mwayaa said, “for the first time a family in my area ward will see that killing cannot go unpunished no matter the status of the killers.”
The officers were arrested after the office of the Director of Public Prosecution wrote to the court requesting for the arrest of the officers over the murder of Katana Kazungu at Tsangatsini area in Kaloleni Sub County.
