The Directorate of Criminal Investigations (DCI) and DPP Garissa branch on Tuesday suffered a major blow after a case they had forwarded to the Garissa High court was rejected over shoddy investigations.
Officers from the two departments had presented a case where a man had posted nude photos on social media.
The photos were posted by a man from Tana River.
Issuing comments after rejecting the case files, the prosecutor said that the charge sheet did not capture crucial evidence to sustain the case and warrant prosecution.
“Investigating officers should prove beyond reasonable doubt that the number used in posting the nude pictures belonged to the accused person and that the alleged mobile phone provider should give a certificate to prove the allegations," stated the Prosecutor.
The case file has since been returned to the respective investigating officer with a number of footnotes of gaps noted.
However, addressing the media outside the Garissa court on Tuesday, Dabaso Mohammed who is a Madogo volunteer and activist, accused the officers from the DCI and DPP's office for allegedly delaying the case.
