Hearing of a forgery case against Kapkures ward MCA Paul Kimtai together with his close aide Richard Langat on Thursday failed to kick off after the defense side applied for an adjournment.
Kimtai's lawyer Gordon Ogolla applied to have the case pushed forward saying they have reached an agreement to settle the matter out of court and needs more time to do so.
In their application, the two want the court to give them three weeks to try and settle the matter.
It has been adjourned over eight times with the complainant crying foul over delays by the defense.
In his ruling Chief Magistrate Josephat Kalo allowed the application for an adjournment saying the matter was fairly old and needed to be expedited on time, he moved the matter to October 4 for mention to confirm the status of the agreement.
The duo who were arrested in 2017, had been charged with forgery of land titles of a plot within Nakuru.
It was alleged that on diverse dates between the month of October 2010 and April 2012 at an unknown place with intent to defraud Josiah Njoroge without lawful authority made a title deed of a land situated at Mbaruk area in Nakuru purporting to be a genuine document issued by the land's registry.
They faced other charges of giving false information to police about the said land which led to the wrongful arrest of lands advocate in Nakuru.
