The High Court on Tuesday declined to drop charges against former Transport Cabinet Secretary Michael Kamau in a case involving alleged loss of Sh33.3 million.
The Office Director of Public Prosecutions (ODPP) has been given the green light to continue a probe against Kamau. The court, however, dropped one count in the suit.
Kamau landed in trouble over the redesigning of the Kamukuywa-Kaaptama-Kapsokwony-Sirisia road in Bungoma.
The court has asked ODPP to prepare a charge against Kamau in line with the law of the nation. In his ruling, Justice John Onyiego said that it is too late to stop the case.
“Having found that the charge sheet as drafted without specific reference to the specific regulation amounts to illegality the same must be quashed. Court should have rejected the charge sheet upon registration,” reads part of the ruling as quoted by Citizen.
Justice Onyieg also said that it is the constitutional right of the former CS to know what he did wrong before he can be prosecuted.
He asked the prosecution to prove that Kamau failed to comply with the code of conduct at work.
