Nairobi based lawyer Nelson Havi has hit out at the office of the Director of Public Prosecutions (ODPP) and the High Court, claiming that they are delaying the murder case against Joseph Irungu and TV journalist Jackie Maribe.
Havi wonders why Jowie is being kept in custody for long if he is not entitled to bail.
Reacting to a ruling by Justice James Wakiaga that declined to grant Jowie bail, Havi said that the DPP and the court could save judicial time by commencing and concluding the murder case.
“The High Court and the DPP could save precious judicial time by commencing and concluding the trial of Joseph Irungu aka Jowie. Why keep a suspect in Court for ages if he is not entitled to bail? Try and convict or acquit him/her within the shortest time possible,” Havi tweed on his official handle on Tuesday.
Jowie and Maribe are jointly charged with the gruesome murder of Nairobi businesswoman Monica Kimani.
The two pleaded not guilty to the charges which they allegedly committed on September 19, 2018 at Lamuria Apartments in Nairobi’s Kilimani area.
On Tuesday, Justice Wakiaga dismissed Jowie’s fresh bail application terming it premature and lacks merit.
Maribe who is charged alongside Jowie is out on Sh1 Million bail but was ordered not to read news pending hearing and determination of the case.
The prosecution intends to call 33 witnesses in the case that is scheduled to start on June 25.
