The former Nairobi Governor Evans Kidero will wait longer to know his fate after a fraud case against him failed to kick off on Monday because of a hitch in court.
The former county boss’ legal team claimed that there is a conspiracy against him after it emerged that the charge sheet presented in court was defective.
A charge sheet, seen by Citizen, did not indicate the offence Kidero was being accused of before he was presented in court.
His team claimed that there was an ill-motive behind the case.
Led by Senior Counsel James Orengo, the legal team asked the court to provide them with a clear charge sheet before the case could kick off as planned.
“A charge sheet is the foundation of a criminal trial once it’s defective there can never be a trial,” said Orengo, as quoted by Citizen.
They also insisted that the prosecution side failed to provide them with crucial documents to help them in preparing their defence.
The prosecution team claimed that Kidero’s side was playing games in a bid to rescue the former ODM governor.
Prosecutor Joseph Irungu insisted that Kidero’s side was raising issues which had been addressed during the submission stage of the case.
He insisted that there is no need to halt the hearing.
Kidero’s case will be mentioned on April 3, 2019.
