A Nakuru high court presiding Justice Joel Ngugi has decried the manner in which survivors of physical assault are charged a fee to have P3 forms from Nakuru Level 5 hospital.
Speaking in Nakuru on Tuesday during a stakeholders workshop on prevention of Gender Based Violence cases in Nakuru, Ngugi said victims of physical assault should not be charged the current fee of Sh1,100 to have the P3 Forms but rather obtain them free of charge.
"There is need to waiver the Sh1,100 fee being charged for P3 Forms at the Nakuru Level 5 Hospital for the survivors of physical assault. This can be looked at the policy level," said Justice Ngugi.
He also called on medical practitioners, prosecutors and investigators dealing with matters of gender-based violence to ensure victims get justice.
"Matters of defilement cannot be proved by looking at bruises or scientific evidence but they are proved by evidence beyond reasonable doubt," he said.
Sentiments echoed by Justice Liz Gicheha who added that matters of SGBV should be taken seriously.
"In matters of SGBV cases let us ensure we do not cut the chain of justice from investigations, hearing up to the time the cases are determined," said Justice Gicheha.
Already Legal Resource Foundation has filed a case on the same seeking to have no fee charged to obtain the P3 Forms for survivors of physical assault.
