Political analyst and High Court Advocate Francis Weda has sought to correct at a section of Kenyans questioning why Deputy Chief Justice Philomena Mwilu remains a free person despite being implicated in graft.

Mwilu was last week arrested over allegations of tax evasion and graft among others was released on Sh5 million bond by Anti-Corruption Court Chief Magistrate Lawrence Mugambi.

Speaking on KBC English Service Wednesday morning, Weda noted that Mwilu’s case had to be handled with care, hence her release the very same day, despite some other suspects facing similar allegations having to spend days in cells awaiting release.

He said that Mwilu’s position as the second highest person in the Judiciary fuelled the same, noting that no judge would misbehave when dealing with their boss.

‘’This is the sitting Deputy President of the Judiciary and must be treated with dignity. You do not expect a magistrate to misbehave when handling such a case,’’ he said.

He added that the fact that Mwilu has not taken a plea in the case whose hearings have since been pushed until October 9 warrants her the liberty to continue with her operations at the Supreme Court judge.

‘’She did not take a plea and, therefore, remains a free person and is free to continue carrying out her responsibilities,’’ he added.

Mwilu's case seemed different from similar ones involving Busia Governor Sospeter Ojaamong' and his former Nairobi counterpart Evans Kidero, both of whom spent days in custody before securing their release.
