Kisii Governor James Ongwae has been issued with a seven days notice by High Court to respond to a tendering case filed against him.
Kisii High Court Judge David Majanja also ordered the governor to serve the petitioners with the affidavits.
The petitioners, Vincent Gekonge and Boniface Mangaa have accused the governor to have broken tendering rules and want Ongwae to disclose the contractors renovating Kisii town streets ahead of the Kenya Inter County Sports and Cultural Association games.
Samson Sagwe, the petitioners' lawyer argued that none of the contractors have had their identities revealed in signposts or adverts as required by law.
The county executive in charge of roads and Mr Ongwae’s chief officer, urban engineer, head of procurement and the county government have also been enjoined in the case.
The streets reportedly undergoing renovation include: the roads linking Kisii Police Station with Cooperative Bank branch, Victory Catholic Church and National Bank, Capital and Shivling Supermarket road and the Kisii Level Six Hospital and Falcon junction.
The petitioners now want the court to invalidate the tenders and holders of the officers mentioned in the case, among them is that Governor James Ongwae should be declared unfit to hold public office following the tendering scandal.
