An 85-year-old grandmother from Makueni has appealed to the Chief Justice David Maraga, the office of the Attorney General (AG) and the Director of Public Prosecutions (DPP) to intervene and help her end a 34-year-old land case.
Mbwele Muoki, a widow says she has been living a miserable life after her land was allegedly grabbed by a son to a former chief.
Muoki has now been forced to live in a grass-thatched house and bury her kin on borrowed burial sites over years despite the courts ruling in her favour several times.
“I have never given any of my children a good send-off, circumstances have forced me to bury two of my sons away from home as we were barred from burying their remains in my land that I own the title deed, ” she told Hivisasa at her home in Tamutamu village, Saturday
The land under question is 11.3 hectares which is at Kaseve village, Malivani, at the peripherals of Wote town, in Makueni constituency. It is said to have been sold to the accused at Sh29,000 in 1980.
Armed with bulky documents obtained from courts bearing both judgments and rulings from various High Court Judges in her favour, the grandmother says justice has never been fully served.
"Once a ruling is made in court, the man runs to the same court and gets orders preventing us from getting him evicted from my land, he has been playing such delay tactics for me to die so that he might possess my land fully,” the old woman decried.
However, according to a certificate of confirmation of grant issued at the Machakos High Court in 2009 by Justice Isaac Lenaola, Mbwele Muoki and Dennis Muoki were given a grant of representation to the estate of the late Muoki Muasya.
“In any event, Mutie Kioko has no lawful interest in this estate and he can pursue a refund of his money from those that illegally received it,” reads part of the ruling by Justice Oscar Angote.
The 85-year-old grandmother now believes that even if another ruling is made, the accused will apply tricks to buy time until the remaining complainant is dead.
She hoped the Chief Justice, AG and DPP will come to her rescue so that she gets justice.
