Murang’a Senator Irungu Kang’ata has said that he will use different channels to ensure that Chief Justice (CJ) David Maraga resigns following his remarks on the sex age debate.

The senator opined that the head of the apex court in the land overstepped his mandate as far as the debate is concerned.

 He noted that it is unfortunate for the CJ to make such remarks when he is a custodian of the law. 

Maraga had disapproved the manner in which teenagers are handled when it comes to sex offence related cases. 

Speaking during the launch of a two-day peer learning seminar on gender-based violence, Maraga said teenagers, especially boys have become victims of circumstances because of the law.

CJ Maraga noted that attempts by the Federation of Women Lawyers (FIDA) to have the Sexual Offenses Act amended proved futile.

However, the senator said that it is against African morals for the CJ to back the reduction of the sex consensual age, at a time when youths are getting lost. 

He said that the CJ should think twice before making such suggestions in future lest the nation finds itself in a pathetic state. 

“Mr Maraga can’t purport to legislate while sitting at the bench, which is the work of legislators. I will use different avenues to ensure that he resigns because his suggestions on sexual offences will corrupt family values.

"It is unfortunate that he suggests the reducing the consensual age while (I hold that) it should be increased to 22 years,” Kanga'ta said, as quoted by Daily Nation.

"Mr Maraga’s validation of FIDA’s western values is a testament of judicial capture by NGOs hence the recent pro-gay rulings. I, being a lawyer, will not sit and watch as the judges who should be giving the way mislead the country,” he added.
