A section of leaders from across the country have joined Governor John Nyagarama in celebrations after securing major victory at Appeals Court.
A three bench judge in Kisumu led by Kathurima I'Manoti ruled that the second term ODM governor was elected validity.
"The petitioner has failed to prove that illegalities were committed. Also, there was intriduction of new evidence," read the judgment.
Veteran politician Walter Nyambati, who finished second in 2017 election, had moved to Appeals Court after losing at the High Court.
ODM Secretary General Edwin Sifuna said the victory was an affirmation that the party won fairly.
"We have seen most of petitions agaisnt ODM collapsing. This is a vindicating to us," he said.
Nyamira Senator Okong'o Mogeni added: " It's time now to get back to work. Everybody should be brought on board by the governor."
After the ruling, Nyagarama, who buried his son last week, dedicated the victory to the people of Nyamira.
Earlier, Kisii Governor James Ongwae and Senator Sam Ongeri, who were also in court, urged the governor to unite Nyamira people.
The ruling brings to an end protracted electioneering period in Nyamira, albeit temporarily since Nyambati still has the Supreme Court option.
