The recent form four graduate at Elimu Bora Secondary School in Mandera Town was on Friday arraigned before Mandera Resident Magistrate court but no charges were preferred against him as magistrate Duncan Mtai ordered the suspect undergo mental assessment test.

The prosecution has insisted treason charges would be preferred against the minor once the test is concluded.

But Miguna has hit out at the state, saying any nation that charges students for serious crimes such as treason is a 'collapsing' country.

"Any regime that arrests, detains and charges schoolboys with TREASON is illegitimate, weak, desperate and will soon collapse. That's the stinging lesson of history," the firebrand lawyer posted on his official Twitter account.

According to reports, the student was nabbed after officials of Kenya National Examinations Council (KNEC) discovered the candidate's plan to eliminate Uhuru and Duale in his English Paper One answer sheet.

The student, however, had not indicated the date or location where he was intending to execute his plan.

The Ministry of Education, the Office of Director of Public Prosecutions (ODPP) and the Directorate of Criminal Investigations (DCI) have not issued any statement over the incident.
