Ibeno MCA Mr Charles Maina Chacha has survived a court petition against his August 8 election win after the case was dismissed with costs at the Kisii high court.
Kisii High Court Judge Martin Muya said that despite the fact there were some illegalities on the issues surrounding ballots seals missing, some poling centers having challenges the issues wouldn’t in anyway affect the end results of the polls.
The case was filed by Steven Arika.
Mr Chacha said he had confidence that the courts will vindicate him.
"I am very glad for the legitimacy that the court has seen in my election as a member of county assembly for Ibeno ward, I am promising to work tirelessly for the electorates and calling upon my worthy competitors to down their anger and work with me for the locals," said Chacha.
However, one of the petitioners Mr Francis moenga said the was not pleased by the verdict and he will go to every length to contest the decision.
"I am a really disappointed man and I vow to exploit all available avenues to bring justice to the Ibeno ward people," said Moenga.
