Obado who is facing charges of being involved in the murder of Rongo University student Sharon Otieno, on Monday appealed to be released on bail, a life and death request for him.

If his request is denied in Tuesday's hearing, then the Governor's political profession and his gubernatorial tenure will be at stake

In accordance with article 182(d), of the constitution, the seat will be declared vacant is the holder is convicted of an offence punishable by imprisonment for at least 12 months.

Consequently, his seat will be taken over by his deputy Nelson Mwita, who will lead the county as its Chief for the remainder of the term.

This is most probable should he be convicted, considering that the murder charges he is facing are most likely to put him behind bars for life or be sent to hang if found guilty.

Through his defence team led by lawyer Cliff Ombeta, Obado has sworn an affidavit pleading with the court to consider this among many other reasons why he should be let out of the police cells.

“I’m the governor of Migori County after being voted in overwhelmingly by the people. The allegations of murder facing me, however grave, cannot deny me my basic rights as enshrined in the Constitution,”  read the affidavit in part as was seen by the Standard.

The Governor has been largely mentioned in the murder, with reports indicating that some of his aides who are also in detention have named him as the chief participant.

He has, however, since distanced himself from the same, despite admitting to having been in a close relationship with the slain beauty.
