Changamwe MP Omar Mwinyi has been found guilty of assaulting a police officer during the Orange Democratic Movement (ODM) nominations in April last year.
The court has since sentenced him to a four year jail term if he fails to pay a fine of Sh.1 million. In his ruling, Chief Magistrate Evans Makori on Thursday ruled that there was sufficient evidence that the lawmaker and his supporters had assaulted the police officers.
The officers were later identified as constables Dennis Nambisia and Agapio Ndwiga. The lawmaker was faulted for failing to stop his supporters from assaulting the said officers during the exercise.
"Having carefully considered the evidence by the prosecution, I find the accused guilty as charged. "It is clear the accused failed to restrain or stop his supporters from disrupting the polls therefore he is deemed to have participated in the fracas," he said.
In a medical report presented in court, the officers were found to have been badly injured. The hearing of the case had been adjourned to allow the legislator prepare evidence in his defense.
The officers had been tasked with protecting voters and officers from Independent Electoral and Boundaries Commission (IEBC) officials.
