A 24-year-old woman who was handed a 15-year-jail term for defiling a 16-year-old boy has appealed the ruling at the Kisumu Court of Appeal.

Judith Khayosa Wandera was sentenced to 15-years in jail on May 23 this year, after admitting that she was involved in a sexual relationship with the boy despite being warned by his parents.

The ruling was made by Kisumu principal magistrate Joan Wambilianga.

But on Wednesday, Ms Wandera lodged an appeal against the entire judgment stating that an innocent affair earned her many years in jail.

Through lawyer Bruce Odeny, Ms Wandera now wants the ruling set aside and substituted with an acquittal. 

“Ms Wambilianga disregarded the statutory defense mounted by the appellant. The learned magistrate generally misconstrued the law on un-pleaded issues and on evidence emanating in the course of trial,” reads a section of the court records quoted by the Nation.

While defending herself before the sentence was handed out, Ms Wandera claimed that she could not establish that the boy was a minor on the first day they met.

She told the court that the boy was a boda boda operator, a drug abuser and had dreadlocks. 

She asked for forgiveness but her pleas fell on deaf ears.
