The second term governor had his election nullified by the Appeals Court following a petition by former MP Wavinya Ndeti early this month.

Auditor General Edward Ouko had raised audit queries on how the county government had spent Sh7 billion in 2014/15 financial year without supportive evidence.

Committee chairman Moses Kajwang was forced to send Mutua away after it emerged that he did not have the documents.

“We want quality to be the heart of our proceedings. It will not be productive for us as a committee to continue with this session without seeing the documents you are referring to in your responses,” the Homa Bay lawmaker told Mutua.

In his defense, Mutua said he submitted the required documents to the office of the Senate Clerk last year.

“I am appearing today over the same issue that I was supposed to respond to last year before the elections.

"My assumption was that the documents I submitted last year are still valid and figured out that we don’t need to incur extra costs making photocopies,” he said.

Often, Mutua is not stranger to controversy since in 2016, he disobeyed the same committee's summons.

He has since moved to Supreme Court to challenge nullification of his victory by Appeals Court.
