Samburu Governor Moses Kasaine might spent another night at Industrial Remand Prison after raising concerns about his 'outrageous' bail terms issued by Anti-Corruption court.
Chief Magistrate Douglas Ogoti on Tuesday released Governor Kasaine on Sh100 bail or an equivalent of Sh150 million bond, a sum which the governor protests, terming it ridiculous.
Through lawyer Paul Nyamodi, Kasaine moved to court on Wednesday where be applied to have the bail terms reviewed because he could not afford the amount slapped by the court.
“My Lord the accused is greatly aggrieved by the said terms which are completely outrageous and unprecedented. It goes against the bail and bond policy, specifically that the bond amount should not be excessive and should not be greater than necessary to guarantee that the accused persons will appear in court,” lawyer Nyamodi told the court.
He is accused of trading with the county through Oryx petrol station leading to payment amounting to Sh84, 695,996. His 13 members of the executive are also being sort by the authorities.
“Between March 27, 2013 and March 25, 2019, at Samburu County, being the Governor of Samburu County Government, you used your office to improperly confer upon yourself a benefit of Ksh.84,695,996.55 through Oryx Service Station, a business entity owned by yourself, through the supply of fuel to Samburu County Government,” read the charge sheet.
Mr Kasaine becomes the second governor to spend a night in prison after his Migori counterpart Okoth Obado spend over three weeks in the same facility last year over murder charges. He has denied defrauding the county Sh85 million.
His arrest has elicited mixed reactions from among Kenyans with some praising the EACC while others condemning it for allegedly being biased in the ongoing fight against corruption.
