A Kiambu businessman has filed a case against Governor Charity Ngilu over the torching of a lorry that was allegedly intercepted ferrying charcoal in Kitui County in 2018.

David Waweru has filed the application in Machakos High Court seeking Sh7.5 million compensation from Ngilu.

In court papers filed at the court, the businessman states that he bought the lorry to ferry goods between Nairobi, Kiambu, and Kitui counties.

Through his lawyer, Jeremy Njenga, the businessman wants the court to compel Ngilu and the County Government of Kitui to compensate him.

Waweru states that his lorry was lawfully and carefully being driven from Tana River County loaded with 400 bags of charcoal when it was intercepted and torched.

He adds that the lorry's driver was flagged down by Ngilu in the company of her bodyguards at Kathyoko trading center on the Thika-Garissa road.

The businessman claims that Ngilu then ordered irate youths to torch the vehicle.

“I not only lost the vehicle worth Sh7.5 million, but also a consignment of charcoal worth Sh800,000,” Waweru states in writing.

Waweru has denied claims that the vehicle was ferrying charcoal from Kitui County when it was torched.

Ngilu in response to the case has denied ordering youth to torch the lorry.

The Kitui governor wants the businessman to produce evidence that she flagged his driver down and ordered for torching of the lorry.

The case is filed at the Machakos High Court.

In February 2018, a section of Kiambu leaders led by Governor Ferdinand Waititu demanded for Ngilu’s arrest over the alleged torching of the lorry.

Ngilu was then summoned by the National Cohesion and Integration Commission (NCIC) but denied any wrong doing.
