In what could ignite vicious war between the judiciary and executive, Deputy Chief Justice Philomena Mwilu now says her criminal charges are wider witch-hunt plot by President Uhuru Kenyatta.

Revisiting last year's contested petition in Supreme Court, Mwilu, who is accused of evading taxes, taking bribes and engineering the collapse of Imperial Bank, added that she is a victim of the judgment that nullified Uhuru's victory in 2017.

"Immediately following the determination of the SCOK on September 1 last year, the President made public statements issuing both explicit and implicit threats against the majority judges who decided the outcome of the presidential petition. 

"That is why I believe the impugned charges are not coincidental and appear to be part of a larger scheme to embarrass me, to expose me to ridicule and harassment," she says in a sworn affidavit in court.

On Friday, anti-graft court suspended proceedings on criminal charges pending High Court hearing of a petition challenging constitutionalism of the matter.

After the nullification, Uhuru threatened to  'revisit' the matter and 'fix' the judiciary, something that makes Mwilu believe that she's a victim of the political shenanigan.

"Taken in their totality together with the frivolity of the charges now levelled against me, it is clear the impugned criminal proceedings have been commenced with an ulterior motive and are malicious," she said.

Justice Mwilu, David Maraga, Smoking Wanjala and Isaac Lenaola were the majority who overturned August 2017 polls.
