Justice Jessie Lessit, in her bail application ruling, noted that the two are capable of intimidating witnesses, adding that prosecution proved beyond doubt.

"The second third accused could tamper with investigations. The prosecution proved beyond reasonable doubt why they should remain behind bars until trial," she ruled.

She added: "Their pre-trial will be on February next year before the trial in May. They agreed with most evidence against them over the murder."

But the defense team vowed to appeal the ruling, terming it a contravention of Article 49 of the constitution.

Their boss, Okoth Obado was released on a cash bail of Sh5 million. He will not be allowed to go past 20 kilometres in his jurisdiction and he will not be allowed to get in contact with Sharon Otieno family.

Mr. Obado, Lessit said, prosecution only relied on circumstancial evidence thus the decision to release him on bail. He will not be allowed to seek for adjournment of the case either.

His aides will now have to languish in Industrial Area prison, which has been their home for close to two months now.
