Former Jubilee nominated Senator Joy Adhiambo Gwendo has a reason to smile after the High court in Nairobi set aside a two-year jail term handed to her towards the end of last year.
Gwendo was on December 7th sentenced to a two-year jail term by Anti-Corruption Magistrate Douglas Ogoti without the option of fine after being found guilty of abuse of office and fraud.
She is reported to have issued bank cheques of varying amounts of money in favour of Kisumu East Cotton Growers Cooperative Society with the knowledge that her account had no funds to pay Shs 2.2 million.
In today’s ruling, Justice John Onyiego indicated that the trial court erred in law in sentencing her to jail without the option of a fine.
However, Gwendo is not off the hook just yet.
According to Justice Onyiego, the High Court has powers to review the sentencing and therefore she will be sentenced afresh on Monday, March 4, 2019.
She served as Jubilee Party nominated Senator between 2013 and 2017.
In 2017, she vied for the Kisumu Esat Parliamentary Seat on the ruling Party’s ticket.
She lost to the current MP Shakeel Shabbir.
