An Appeals Court in Eldoret is on Thursday expect to give its verdict on an appeal filed by the Marakwet East Member of Parliament Bowen Kangogo challenging the High Court decision to annul his August 8 poll win.
Bowen filed the appeal after High Court Judge Kanyi Kimondo declared his win as null and void.
Justice Kimondo in his ruling delivered on February 28, said the irregularities in some polling stations in the August 8 election in the constituency cast doubt on the final numbers.
He further said the final results appeared opaque and unverified.
Kimondo also questioned several sets of final results given by the returning officer. In a video clip played in court, the returning officer announced the final tally of 29,573, but in court, he said the final tally was 30,020.
In the results announced by IEBC, Bowen was declared the winner, having beaten his closest rival Linah Jebii Kilimo, an independent candidate with less than 1,000 votes.
A voter, Sammy Kembi had filed the case at the High Court.
The Appeal’s Court ruling comes just a day after delivering another ruling reinstating Alfred Keter as the Nandi Hills MP.
Both Keter and Bowen have been branded rebels within the Jubilee party and the two at some points claimed the election petitions against them were political.
